Terms of Service

Version 1.1.1 — content locked 7 August 2026. Svenska

Editorial content locked at v1.1.1 pending independent legal review. §2 duty-of-care disclosure updated per PRE-210 (rapid-loss trigger, BMI < 18.5 lockout, broadened source citation). Entity registration fields (Norwegian organisasjonsnummer, registered address, MVA number — marked in [amber]) are patched in at Stripe production launch on CEO receipt. Effective date is set on publish with those fields resolved.

These Terms of Service (the "Terms") govern your access to and use of Prelog (the "Service"), a subscription nutrition-tracking web application operated by Agdir Drift AS, a company registered in Norway in the Foretaksregisteret (Brønnøysundregistrene) under organisation number [Norwegian organisasjonsnummer — awaiting CEO input], with registered office at [Norwegian registered office — awaiting CEO input] ("Prelog", "we", "us", "our"). By creating an account or otherwise using the Service, you accept these Terms and enter into a binding contract with Agdir Drift AS.

If you do not accept these Terms, do not use the Service.

1. Who may use Prelog

You must be at least 18 years old to create an account. By registering, you confirm that you are of legal age and that any information you provide is accurate.

The Service is offered to consumers established in the European Economic Area (EEA), the United Kingdom, and Switzerland. Registration is technically open worldwide; if you use the Service from outside the EEA/UK, you are responsible for compliance with any local laws that apply to you.

2. Not medical, clinical, or professional advice

Prelog is a nutrition-tracking service, not a medical device, and nothing shown by the service is medical advice, a diagnosis, or a treatment plan. The service is designed for adults aged 18 to 65 in the EU, UK, or EEA who do not have a clinical condition affecting their nutritional needs.

Where a user's self-declared profile includes a history of an eating disorder, or where the user's body mass index is 40 or above, or where the user's body mass index is below 18.5, Prelog disables energy-deficit planning and offers only a maintenance plan. Prelog also enters this maintenance-only state when the user's logged weight declines by more than 1.5 % of body weight per week, averaged over two consecutive four-week periods. In each of these cases the app directs the user to consult a qualified healthcare professional before continuing.

Prelog also enforces two safety floors on every plan it produces, regardless of what the user requests: a minimum daily calorie target — the greater of a sex-based floor (1500 kcal for men, 1200 kcal for women) and the user's estimated basal metabolic rate — and a maximum daily deficit — the smaller of 20 % of estimated total daily energy expenditure and 750 kcal. These floors are derived from published EU and UK nutrition-science sources (ACSM, ISSN, EFSA, NHS) and cannot be overridden from within the app.

Prelog does not provide medical nutrition therapy. Users with a medical condition, or who need individualised dietary advice, should consult a registered dietitian, doctor, or other qualified clinician.

See §6 for how the duty-of-care lockout interacts with your right to a refund.

3. Your account

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for keeping your credentials confidential and for all activity under your account.
  • You must promptly notify us at [email protected] if you suspect unauthorised access.
  • We may suspend or terminate your account, without refund, if you breach these Terms, engage in fraud, or use the Service in a way that harms the Service or other users. See §11.

4. Subscription, fees, billing

4.1 Plans

Prelog offers a free tier and a paid subscription (the "Subscription"). Plans, prices, and billing periods are presented at checkout and on https://prelog.app. All prices are in EUR. Applicable Norwegian VAT (MVA, 25%) is calculated and displayed at checkout via Stripe Tax; for cross-border sales into other EU/EEA countries we operate under the VOEC scheme where applicable.

At launch, the paid tier is €7 / month, or an annual plan currently under A/B test (candidate €59 / year). Free tier: registration, limited history, single active day. No time-limited free trial — the free tier stands in for one.

4.2 Payment provider

All payments are processed by Stripe Payments Europe, Ltd., Ireland. By subscribing you also accept the Stripe payment terms presented at checkout (stripe.com/legal/consumer). Prelog does not store card numbers; only a Stripe customer identifier and subscription state are stored on our servers.

4.3 Recurring billing and renewal

Subscriptions renew automatically at the end of each billing period at the then-current price for the plan you chose, unless you cancel before the renewal date. You can cancel any time from your account settings or the Stripe Customer Portal.

4.4 Price changes

We may change subscription prices from time to time. Any price change applies to your next renewal period, not the current one, and we will notify you by email at least 30 days before it takes effect. If you do not accept the change, cancel before the renewal date; continued use after the effective date constitutes acceptance.

4.5 Failed payment

If a scheduled payment fails, Stripe will retry per its standard dunning schedule. We may downgrade or suspend paid features after final retry failure. Your data remains available on the free tier until you either resolve payment or delete the account.

5. Right of withdrawal and digital-content exception

As a consumer, you generally have a 14-day right of withdrawal from the day the Subscription contract is entered into, under the Norwegian angrerettloven (Lov om opplysningsplikt og angrerett ved fjernsalg og salg utenom faste forretningslokaler) §21, which implements EU Consumer Rights Directive 2011/83/EU (applied in Norway via the EEA Agreement).

However, the Service is supplied as digital content and digital services that begin execution immediately upon payment. At checkout you are asked to tick a box giving your prior express consent to begin performance during the withdrawal period and confirming that you acknowledge you thereby lose the right of withdrawal (angrerettloven §22 letter n / CRD Art. 16(m)). If you tick that box and we begin providing the Service, the 14-day withdrawal right no longer applies.

If you do not consent to immediate performance, we will hold your Subscription in a not-yet-active state for 14 days. During that period you can withdraw at no cost by emailing [email protected] or by sending the model withdrawal form at Annex I.

Even where the statutory right of withdrawal has lapsed, our voluntary refund practice under §6 still applies. Full refund policy: /legal/refund.

6. Voluntary refund practice

Beyond the statutory right in §5, we voluntarily offer:

  • Pro-rated refund on medical grounds. If the automatic duty-of-care lockout (§2) activates within your first paid billing period, contact [email protected] and we will refund the unused portion of that period.
  • Discretionary goodwill refund. For any other reason within the first 14 days of a new Subscription (not a renewal), contact [email protected] and we will process a full refund without asking why.
  • No refunds after 14 days. Renewals and continued use beyond 14 days are non-refundable except where required by mandatory law.

Refunds are made to the original payment method via Stripe within 14 days of approval.

7. Your content and your data

You retain all rights in the food logs, weight entries, chat messages, notes, and photos you submit ("Your Content"). You grant Prelog a limited, non-exclusive, worldwide, royalty-free licence to store, process, and transmit Your Content solely to operate, maintain, and improve the Service — including transient transmission to the language-model sub-processor named in the Privacy Policy for the purpose of parsing food descriptions and label photos into structured nutrition data.

We do not sell Your Content, we do not use it for advertising, we do not train third-party models on it.

Processing of personal data is described in the Privacy Policy and, for our sub-processor arrangements, in the Data Processing Addendum.

8. Acceptable use

You will not:

  • reverse engineer, decompile, or attempt to derive source code of the Service, except to the minimum extent permitted by mandatory law;
  • circumvent, disable, or interfere with security or authentication features;
  • access the Service by any automated means (scraping, bots) other than public endpoints intended for automation;
  • resell, sublicense, or make the Service available to third parties on a service-bureau basis;
  • upload content that is unlawful, defamatory, infringing, or that contains malware;
  • use the Service to attack, harass, or infringe the rights of any other person;
  • use the Service to log or plan nutrition for another identifiable person without their knowledge and consent;
  • use the Service in a way that would cause Prelog to violate any applicable law.

9. Intellectual property

All intellectual property in the Service — including source code, design, brand, and documentation — belongs to Agdir Drift AS or its licensors. Nothing in these Terms transfers any of that IP to you. You are granted a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose during your paid or free subscription period.

10. Third-party services

The Service integrates third-party sub-processors listed in the Privacy Policy. Their availability is outside our control. We are not responsible for interruptions or defects in those third-party services, but we will make reasonable efforts to work around or replace a failing sub-processor.

11. Suspension and termination

You may terminate your account at any time from the account settings page, which triggers deletion under the process described in the Privacy Policy. Termination during a paid period does not by itself trigger a refund; see §6.

We may suspend or terminate your account, with or without notice, if:

  • you materially breach these Terms;
  • you engage in fraud or chargeback abuse;
  • required by law, court order, or regulator;
  • the Service is discontinued in whole or in part (in which case we will give at least 30 days notice by email and pro-rate any prepaid unused fees).

12. Beta features and changes

Prelog is under active development. We may add, change, or remove features at any time. Where a change materially reduces the paid functionality you are receiving, we will notify you by email at least 30 days in advance and offer either the ability to cancel with a pro-rated refund or to accept the change.

Features labelled "beta", "preview", or similar are provided as-is and are not guaranteed to be stable or continuously available.

13. Warranty disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of nutrition figures. Nutrition estimates carry a typical individual error band of about ±10% (Mifflin-St Jeor for BMR/TDEE; wider for photo-based portion estimation).

Nothing in this section limits any warranty or right that cannot be excluded under mandatory consumer-protection law in your country of residence.

14. Limitation of liability

To the maximum extent permitted by law:

  • Prelog is not liable for indirect, incidental, special, consequential, or punitive damages; loss of profits; loss of data; or loss of goodwill.
  • Prelog's total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the amount you actually paid Prelog for the Service in that 12-month period, or EUR 100 if you are a free-tier user.
  • Prelog is not liable for any health, medical, or physical outcome arising from your use of the Service. See §2.

Nothing in this section limits any liability that cannot be limited under mandatory law, including liability for personal injury caused by gross negligence or wilful misconduct, or for fraud.

15. Force majeure

Prelog is not liable for delay or failure caused by events beyond its reasonable control, including internet or utility failures, acts of government, or third-party sub-processor outages.

16. Changes to these Terms

We may update these Terms from time to time. Non-material updates (typos, clarifications) take effect on publication of the new version at /legal/terms. Material updates (changes to pricing structure, refund rules, liability, jurisdiction, sub-processors that touch personal data) will be notified to registered users by email at least 30 days before they take effect. If you do not accept a material change, cancel before it takes effect.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Kingdom of Norway, without regard to conflict-of-law rules. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of Oslo tingrett, Oslo, Norway — subject to any mandatory consumer-law right you have to bring proceedings in the courts of your country of residence within the EEA/UK, and to sue us in those courts (Brussels I bis Regulation (EU) 1215/2012 Art. 18 and the 2007 Lugano Convention Art. 16(1)–(2), to which Norway is a party as an EEA state). Rome I Reg. (EC) 593/2008 Art. 6, as applied in Norway via IPR-lovvalgsloven, continues to protect you where the law of your country of residence grants greater protection than Norwegian law.

Consumers in the EU also have access to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
